Judge Marilyn Hall Patel of Federal District Court in San Francisco has ruled that the United States Defense Department violated the National Historic Preservation Act by failing to evaluate the potential effect of a planned United States air base in Okinawa on a recognized Japanese national treasure ― a big, slow-moving aquatic mammal called the dugong ― and ordered it to do so. The dugong, associated with traditional creation myths, is listed on Japan’s register of protected cultural properties. In the case, Okinawa Dugong v. Gates, No. 03-4350, the judge sided with environmentalists who said plans to relocate the Futenma Air Station, a Marine Corps base, to a site off the northeast coast of Okinawa would threaten the dwindling number of dugong that live in the seagrass beds. The decision, made Thursday, is the first time the Historic Preservation Act has been applied to an overseas project, Judge Patel said.

Plaintiffs, consisting of the Okinawa dugong, three individual Japanese citizens, and six American and Japanese environmental associations, brought this action against defendants Robert Gates, Secretary of Defense, and the United States Department of Defense (“DOD”) for violations of section 402 of the National Historic Preservation Act (“NHPA”), 16 U.S.C. § 470a-2, and the
Administrative Procedure Act (“APA”), 5 U.S.C. §§ 701-706. Plaintiffs allege that defendants have approved the plans for construction of the Futenma Replacement Facility (“FRF”)―a military air station off the coast of Okinawa Island―without taking into account the effect of the military facility on the Okinawa dugong, a marine mammal of cultural and historical significance to the Japanese people.

Judge Marilyn Hall Patel of Federal District Court in San Francisco has ruled that the United States Defense Department violated the National Historic Preservation Act by failing to evaluate the potential effect of a planned United States air base in Okinawa on a recognized Japanese national treasure ― a big, slow-moving aquatic mammal called the dugong ― and ordered it to do so. The dugong, associated with traditional creation myths, is listed on Japan’s register of protected cultural properties. In the case, Okinawa Dugong v. Gates, No. 03-4350, the judge sided with environmentalists who said plans to relocate the Futenma Air Station, a Marine Corps base, to a site off the northeast coast of Okinawa would threaten the dwindling number of dugong that live in the seagrass beds. The decision, made Thursday, is the first time the Historic Preservation Act has been applied to an overseas project, Judge Patel said.

"Pursuant to recent analysis of program resource execution plans, the Program is adjusting the internal launch dates for the CxP Flight Manifest as follows:
1. Ares 1-Y shifted 12 months from September 2012 to September 2013
2. Orion 1 shifted 9 months from March 2013 to December 2013
3. Orion 2 shifted 6 months from September 2013 to March 2014
4. Orion 3 shifted 3 months from March 2014 to June 2014
5. Orion 4 is not shifted and remains on September 2014"

"This year should also see the final three launches of a global positioning system satellite on the venerable Delta II rocket. The launches are currently set for March, June and September. After that, GPS satellites will be launched aboard Atlas V boosters. Other national security launches on the manifest include the second launch of a WGS satellite on an Atlas V, the first launch of another advanced military communications spacecraft called the Advanced Extremely High Frequency satellite or AEHF, also on an Atlas V and the launch of a National Reconnaissance Office payload."
